A $3,000,000.00 medical malpractice settlement - An obstetrician failed to appreciate our client's signs and symptoms of cervical cancer. By the time the cancer was diagnosed, the cancer had spread to multiple organs, and our client passed away from the cancer.

A $2,700,000.00 settlement in a medical malpractice action against a hospital and an anesthesiologist. Our client was undergoing a surgical repair of a ruptured Achilles tendon under regional anesthesia, specifically by epidural with conscious sedation. It was alleged that when our client's vital signs significantly changed, specifically his oxygen saturation level decreasing from 99% to 59% over the course of several minutes, that the attending anesthesiologist failed to timely monitor the patient and appreciate the distress. The declining oxygen saturation resulted in our client suffering a respiratory arrest. The terms of the settlement included a waiver of an $800,000.00 lien for medical expenses, as well as a $1.9 million cash payment by the insurance carrier for the attending anesthesiologist. A $2,400,000.00 settlement in a product liability action obtained on behalf of our client, a chef, whose leg and ankle were burned when a defective piece of commercial kitchen equipment discharged hot water. A $1,950,000.00 settlement for a 44 year old husband of four girls when he passed out in a deli one morning before work. He was emergently taken to a Suffolk County Hospital, where the hospital failed to timely diagnose a hemorrhage.  The case was litigated against the hospital and a neurologist who failed to timely initiate TPA (a clot busting medication) and against an internist who tried to manage our client over the phone.  This internist mismanaged our client's blood pressure causing, it was alleged, a worsened stroke outcome.  Our client was deprived the opportunity to receive TPA, and further that the mismanagement of our client's blood pressure led to a worsened stroke outcome.  The case was settled at the start of jury selection.

A $1,850,000.00 jury verdict obtained in a motor vehicle negligence case on behalf of a young woman who sustained a fractured femur and subsequently developed a neurologic pain disorder known as Reflex Sympathetic Dystrophy (RSD).

We argued that the apartment door that was recently installed by the New York City Housing Authority, was installed improperly thereby making it difficult for the injured boy to escape the apartment during the fire.

A $1,000,000.00 settlement in a wrongful death/construction site accident that arose out of an incident involving a forklift.  Our client, the forklift operator, was attempting to transport a load of bricks underneath a parking garage “height restrictor,” when the wheel of the forklift struck the side pole and caused the forklift to fall resulting in our client’s death.  The settlement value included the value of the workers compensation lien amount, which was waived as part of the settlement.

A $750,000.00 settlement for a 51 year old woman who was crossing a residential road as a pedestrian when the defendant made a left turn into her.  Our client sustained a left knee injury which required immediate surgery, and a subsequent surgery to repair the damages.  One year later our client underwent a hip replacement to the same side of her body of her injured knee.  Our client's doctor opined that the hip surgery was caused by her gait being thrown off due to the two knee surgeries. The case was settled just prior to jury selection.

A$575,000.00 settlement for a young man driving a truck in the course of his employment, when his truck was hit in the rear by another truck. Our client sustained lower back and knee injuries that required three arthroscopic surgeries. With the case on the trial calendar in Nassau County, a settlement in the amount of $575,000 was secured.

A $510,000.00 settlement for a 69 year old woman who was attending her grandson's wrestling match at a prominent Long Island Catholic high school.  The gymnasium floor was "carpeted" with a crimson colored wrestling mat.  The borders of the wrestling mat were laid directly over the border of the basketball court which was the same crimson color. Plaintiff was unable to determine where the wrestling mat ended due to the color of the mat and the floor being identical.  Plaintiff tripped and sustained a fractured nose.  Eight days following the incident, she was rushed to the hospital where it was determined she sustained a subdural hematoma requiring craniotomy with extended hospital and inpatient rehabilitation.  This case was rejected by a large Long Island law firm stating that the defect was "open and obvious" and that plaintiff would not recover due to the nature of the accident.  Mr. Gunn took the case, visited the accident location, retained an engineer and developed a theory of negligence that resulted in the settlement at the time the case was on the trial calendar.

A $502,500.00 settlement for our client, a 61 year old woman who visited an optical center chain to pick up eye glasses.  When she attempted to sit on a pedestal stool located within the store, the cushion of the stool fell from the pedestal causing our client to fall to the ground sustained injury to her lower back. Our client previously had back surgery and this injury caused her to have multiple surgical revisions on her back  We sued the product manufacturer, the product installer and the optical store.  After jury selection, the installer and manufacturer settled for $227,500.  The optical store broke off all settlement discussions and the case proceeded to trial in Nassau County against the optical store.  Mr. Gunn tried the case to successful conclusion with a jury finding the optical store 80% responsible for the accident.  After the verdict, the optical store offered $275,000 to settled the case, which totalled $502,500.

A $492,500.00 settlement in a slip and fall accident. Our client in this case was a surgeon who slipped and fell while leaving his office on a floor that had just been mopped. The defendant cleaning company failed to mark the area as being wet. As a result of the incident, our client sustained an injury to his ulnar nerve which required surgery, and he also sustained economic loss during the time period that he missed work.

A $440,000.00 settlement in a products liability action.  Our client, a 60 year old female, fell and sustained a head injury which resulted in her permanent loss of taste and smell.  The accident occurred when our client’s foot went through a concrete step, and the case was against the manufacturer of the step alleging that the hollow step constituted a defective design. A $425,000.00 settlement in a medical malpractice action (Westchester County, NY) on behalf of the Estate of a 25 year old woman who passed away from a massive pulmonary embolism. The case was brought against an interventional radiologist, who was in the process of removing an inferior vena cava filter that had been placed within the decedent in order to provide protection against further pulmonary embolus.

A $375,000.00 settlement for a 48 year old woman who fell down the basement stairs of her Rockville Center apartment building.  The basement stairs were modified by the apartment owner to "try" to accommodate a ramp and stairs.  The accommodation was so the building superintendent could wheel equipment down to the basement.  Mr. Gunn retained an expert to inspect the stairwell.  This expert found multiple building code violations.  Our client sustained a fractured ankle that required two surgeries.  While on the trial calendar in Nassau County, a settlement in the amount of $375,000 was secured at a mediation.

A $375,000.00 settlement in a medical malpractice action against a neurosurgeon and a prominent New York hospital. The case arose out of a surgical error that resulted in unnecessary scarring to the top of our client's head.

A $350,000.00 settlement in a medical malpractice action against a New York hospital. The hospital only offered $50,000.00 to settle when our client would have accepted $200,000.00. The case proceeded to trial and after several days of testimony the hospital settled for $350,000.00.

A $350,000.00 settlement in a medical malpractice action against a physician who delayed diagnosing an adverse drug reaction with respect to medications that were being administered to our client.

A $350,000.00 settlement in a medical malpractice action against a physician who failed to timely treat our client, who was suffering from an asthma attack at a walk-in emergency treatment center.

A $337,500.00 motor vehicle settlement - Our client was a passenger on a bus traveling from Brooklyn to Atlantic City, N.J. The bus crashed on the Garden State Parkway. Our client fractured her ankle.

A $300,000.00 settlement in a medical malpractice action against a New Jersey plastic surgeon.  The case involved an allegation of improper surgical technique during bilateral otoplasty surgery, which resulted in a significant deformity of both of our client’s ears.
